3 Canada Immigration Changes Announced By Marc Miller

On December 17, 2024, Marc Miller, Minister of Immigration, Refugees and Citizenship Canada (IRCC), announced significant reforms to Canada’s immigration system.

These measures aim to enhance fairness, security, and efficiency in managing migration while addressing challenges at the U.S. border.

Furthermore, Marc Miller also kind-off confirmed the removal of LMIA-based job offer points in the Express Entry system as we reported in November 2024.

Below is a comprehensive breakdown of the announcements and their implications.

1. Ending ‘Flagpoling’ to Streamline Border Operations

One of the major reforms involves the elimination of ‘flagpoling,’ a practice where temporary residents leave Canada and re-enter through a port of entry to access immigration services more quickly.

According to Miller, flagpoling consumes valuable border resources, hinders critical enforcement activities, and disrupts cross-border traffic.

Moving forward, temporary residents will need to apply online to extend their stay in Canada, thereby reducing unnecessary strain on border officers and ensuring that resources are allocated effectively.

2. Strengthening Control Over Immigration Documents

To enhance the integrity of the Canadian immigration system, the government has proposed amendments to the Immigration and Refugee Protection Act.

These changes would grant IRCC greater authority to:

  • Cancel, suspend, or modify immigration documents, such as visas, in cases of fraud or security risks.
  • Suspend or stop accepting applications in situations deemed to be in the public interest, such as large-scale fraud attempts.

By introducing these measures, Canada aims to prevent individuals who may pose risks from entering the country and to safeguard public resources more effectively.

3. Addressing LMIA Fraud and Express Entry Integrity

The government is also introducing reforms to the Express Entry system to reduce fraud and ensure fairness stamping the credibility of our news published on November 22, 2024.

Specifically, additional points for job offers under Express Entry will be removed, reducing the incentive for individuals to exploit the Labour Market Impact Assessment (LMIA) process.

This change is expected to:

  • Curb the misuse of job offers for immigration purposes.
  • Increase fairness and integrity in the Express Entry system.

Measures to Reduce Irregular Migration

As per the immigration minister, they remain committed to maintaining safe and orderly migration.

Under the Safe Third Country Agreement (STCA), asylum seekers must claim refugee status in the first safe country they enter, whether Canada or the United States.

Expanded in March 2023 to cover the entire land border, including internal waterways like the Great Lakes, the STCA has already led to significant reductions in irregular crossings.

Key Results:

  • Illegal crossings into Canada dropped from 165 per day in March 2023 to just 12 per day following the implementation of extended border measures.
  • The imposition of partial visa requirements on Mexican nationals in February 2024 resulted in a 92% overall drop in asylum claims from Mexican citizens compared to 2023.

Enhancing Collaboration with International Partners

To further mitigate risks and enhance border security, the Canadian government is working closely with the United States, to:

  • Improve information-sharing mechanisms.
  • Strengthen electronic travel authorization (eTA) vetting processes.
  • Propose a North American Joint Strike Force to target transnational organized crime.

Additionally, the Canadian government plans to establish three regional hubs where federal, provincial, and local law enforcement will collaborate to intercept organized crime and illegal drugs more efficiently.

Legislative Amendments for Public Interest Protections

In cases of mass fraud or other exceptional circumstances, the proposed legislative changes will allow IRCC to take swift action, such as suspending or cancelling applications and documents.

These measures aim to protect the Canadian immigration system from abuse and ensure its continued credibility.

Results Achieved So Far

Several key statistics illustrate the impact of the government’s efforts:

  • Mexican Asylum Claims: Claims dropped by 97% after imposing a partial visa requirement for Mexican nationals.
  • Irregular Crossings: Illegal crossings by Canadian visa holders into the U.S. decreased by 84% since June 2024.
  • Refusal Rates: For countries with high levels of visa abuse, the refusal rate has reached 61%.

These statistics highlight the effectiveness of the government’s policies in addressing both irregular migration and visa exploitation.
